Welcome to TennisApp. By accessing or using our services, you agree to be bound by these Terms of Service. Please read them carefully before using our platform.
Acceptance of Terms
By creating an account or using TennisApp, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. You must be at least 18 years old to use our services. By using TennisApp, you represent that you meet this requirement.
Our Services
TennisApp provides a platform for: • Court reservations and management • Tournament and league organization • Club membership management • Digital wallet and payment processing • Communication between clubs and members • Performance tracking and analytics
Payments and Refunds
• All payments are processed securely through our payment providers • Refund policies are determined by individual clubs • Wallet balances are non-transferable between clubs • We reserve the right to suspend accounts with outstanding balances • Currency and pricing are determined by each club
Prohibited Activities
You agree not to: • Violate any applicable laws or regulations • Infringe on the rights of others • Transmit harmful or malicious content • Attempt to gain unauthorized access • Interfere with the proper working of the service • Create multiple accounts for fraudulent purposes
Artificial Intelligence (AI) Usage
Our platform includes AI-powered features such as the reservation assistant, recommendation engine, automated analytics and chat support. By using these features you acknowledge and agree that: • AI responses are provided for informational purposes only and are not a substitute for medical, legal or financial advice; they may contain errors. • AI features are powered by third-party providers (e.g. Google, OpenAI). Data sent to these services is processed under their respective policies. • To prevent abuse, excessive consumption or cost/security risks, we may apply per-user daily token/request limits. • We reserve the right, at our sole discretion and without prior notice, to modify, restrict, temporarily suspend or permanently terminate any AI feature at any time. • Misuse, automated request flooding, manipulative usage or behavior that violates these Terms may result in unilateral revocation of AI access for the user concerned. • You are solely responsible for any decisions you make based on AI output and for the consequences of those decisions.
Service Availability and Third Parties
TennisApp is provided on a commercially reasonable best-effort basis but is not guaranteed to be uninterrupted or error-free. We are not liable for outages, delays, data loss or malfunction caused by: • Server, database or infrastructure failures and scheduled/unscheduled maintenance. • Failure, latency, policy change or shutdown of third-party services we rely on (Firebase, Google Cloud, payment providers, SMS/email providers, maps, weather, AI providers, push notification services, etc.). • Issues caused by internet service providers, telecom infrastructure, DNS, CDN or cloud providers. • Cyber attacks, DDoS, viruses, malware or unauthorized access attempts. • Force majeure events (natural disaster, fire, epidemic, war, strike, government decrees, internet restrictions, etc.). • Problems originating from the user's own device, operating system, browser or network connection. We may schedule maintenance windows, disable features or apply technical limits to keep the service running. If a third-party service changes, we are not obligated to provide an equivalent alternative.
Device and Platform Compatibility
TennisApp is built for iOS and Android. We do not guarantee that every feature works on every device: • Features such as the E-lif algorithm and dynamic club-icon switching depend on Google Mobile Services (GMS) and standard Apple Push / iOS APIs. • On Huawei (HarmonyOS / EMUI ≥ 10) and other devices without Google services, dynamic icon switching, push notifications, map services, AI features and the E-lif algorithm are not guaranteed to work. Some features may be incomplete, broken or fully disabled on these devices. • On sideloaded, jailbroken or rooted installs, or builds delivered outside the official stores, capabilities like signing, push notifications, in-app purchases and dynamic icons may fail to function. • On older operating systems (iOS < 14, Android < 8) the app may fail to install or behave unexpectedly. • Some features may be unavailable in specific regions due to local laws or app-store restrictions. We are not liable for missing functionality, user error, data loss or financial harm caused by unsupported or restricted platforms.
Source Code License & Ownership
Clubs subscribing to the Be Tennis platform are entitled to acquire the application source code under the following conditions: • After maintaining an active paid subscription for an uninterrupted period of 12 (twelve) months, the club owner earns the right to request and download the platform source code. • Source code includes: (a) the mobile application (iOS and Android) source code customized for the respective club; (b) the web admin panel source code; (c) the Firebase database schema and configuration files. • Source code does NOT include: (a) the multi-club selection screen and centralized platform infrastructure; (b) Be Tennis brand assets, logos and commercial graphics; (c) third-party API keys, certificates and license files; (d) data belonging to other clubs. • The delivered source code corresponds to the version current at the date of download. Subsequent updates, new features or bug fixes are not automatically included. • The club may freely use, modify and publish the source code under its own brand for its own commercial activities. However, the source code may not be sold, sublicensed, publicly distributed or released as open source to third parties, directly or indirectly. • Original copyright notices in the source code must be preserved. • If the subscription is cancelled or payment is missed before the 12-month period is completed, the right to request source code does not arise. The period starts from the confirmation of the first payment.
Source Code Delivery & Migration
The following rules apply to clubs that have earned the right to download source code: • Source code is delivered digitally via the "My Club" module in the web admin panel. • The delivered package includes: mobile application source files, web panel source files and Firebase database configuration. • Firebase database export is also available through the same module. The club can migrate the data by creating its own Firebase project. • Be Tennis has no obligation to provide technical support for installation, configuration, server setup, domain pointing, app store publishing or any migration activities after source code delivery. • Receiving the source code does not require the club to leave the platform. The club may continue on the platform with an active subscription and benefit from further updates. • Clubs choosing to stay on the platform continue to benefit from all updates, new features and technical support by renewing their existing package. • Clubs that leave the platform after downloading the source code have no right to access updates released after the download date.
Support Policy
Support terms during and after an active subscription are as follows: • During active subscription (first 12 months and subsequent renewals): Technical support, bug fixes and feature updates related to the platform are provided within the scope of the subscription. • After downloading source code and leaving the platform: (a) Be Tennis has no obligation to provide free technical support to departing clubs; (b) paid consultancy services may be offered upon request; however, acceptance is entirely at Be Tennis's discretion; (c) paid support requests are evaluated on a project basis and may require a separate service agreement. • Clubs that continue on the platform enjoy uninterrupted standard support. • Be Tennis reserves the right to change the scope of support, response times and support channels at any time.
Limitation of Liability
TennisApp is provided "as is" without warranties of any kind. We are not liable for: • Service interruptions or errors • Loss of data or content • Actions of third parties • Indirect, incidental, or consequential damages • Issues arising from club-member relationships
Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes through the app or via email. Your continued use of TennisApp after changes constitutes acceptance of the modified Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
